HIPAA Compliance & Medical Evaluation Consent
Patient Health Privacy & Clinical Evaluation Agreement • Effective Date: August 2026
TintExemption adheres to strict HIPAA security and privacy requirements. All medical records, intake questionnaires, and personal health information are maintained within secure, HIPAA-compliant systems with 256-bit SSL encryption. Access to this information is strictly limited to you and the licensed healthcare professional assigned to your evaluation. Your health data is protected and handled with the highest standards of medical confidentiality.
Agreement for Online Medical Evaluation Consent
I acknowledge that TintExemption provides administrative and technology services that facilitate my connection with a licensed healthcare professional (“Provider”) through its online platform for medical evaluations related to light sensitivity, photophobia, migraines, and statutory medical window tint exemptions. These services may include medical assessment, clinical questionnaire review, documentation, follow-up, and patient education.
Online evaluations include consultations, electronic reviews, secure transfer of health records, digital communications, and documentation review using interactive web forms and electronic data technologies. I hereby consent to engage in online evaluation services with my assigned Provider.
I understand that my reviewing Provider is an independent contractor and is not an employee or agent of TintExemption.
Benefits of Online Evaluation
I understand that the expected benefits of an online medical evaluation include:
1. Improved and direct access to state-licensed physicians.
2. The convenience of completing medical evaluations remotely from home.
3. Efficient clinical review and electronic documentation delivery.
4. Access to Providers licensed in the specific state in which I reside.
Confidentiality
I understand that I have the same rights to confidentiality for online evaluation services as I would for in-person medical evaluations. Any personal or health information disclosed during online encounters is strictly confidential to the extent permitted by state and federal law under HIPAA.
Risks of Electronic Evaluation
As with any form of medical evaluation, there are potential technical limitations associated with online communications, including:
1. In rare cases, information transmitted electronically may be insufficient for complete clinical decision-making, in which case an in-person follow-up may be advised.
2. Delays in evaluation or documentation delivery due to internet equipment or electronic communication failures beyond reasonable control.
3. The possibility of disruption or unauthorized access due to electronic transmission vulnerabilities, despite robust security safeguards.
Patient Acknowledgments and Consent
By proceeding with the intake questionnaire, I acknowledge and understand the following:
1. Online evaluation is the use of electronic communications to deliver healthcare services when the Provider and patient are in different physical locations.
2. I have the right to withhold or withdraw consent to online evaluations at any time without affecting my right to future care.
3. Alternative methods of medical care, including in-person physician visits, are available to me.
4. All medical information and symptom descriptions I provide to TintExemption and the Provider are accurate, complete, and truthful.
5. I am responsible for maintaining privacy in my physical environment while completing my intake session.
6. If the Provider determines that an online review is insufficient for my evaluation, I may be advised to seek in-person clinical care.
7. Online evaluations for window tint exemptions do not replace ongoing primary care, emergency care, or comprehensive ophthalmological treatment.
8. Technical failures may occasionally occur, and I agree to hold harmless TintExemption and my Provider for delays caused by such electronic disruptions.
Emergency Situations
TintExemption does not provide emergency medical services. If you are experiencing a medical emergency, acute eye trauma, or severe health crisis, immediately dial 911 or proceed to the nearest hospital emergency room.
No Guarantee of Certification
TintExemption does not guarantee that a reviewing physician will issue a medical window tint exemption or that any law enforcement officer, inspection facility, or court will accept documentation if state statutory requirements are not met. Certification is issued solely at the licensed physician's independent clinical discretion.
Use and Sharing of Information
I understand that my healthcare and contact information may be shared with authorized administrative personnel strictly for evaluation review, certificate generation, billing, and regulatory compliance, in accordance with our Privacy Policy.
Consent & Authorization
By completing the intake process and checking the consent agreement on the checkout page, I confirm that I have read, understood, and voluntarily agree to this Medical Evaluation Informed Consent. An electronic record of this consent shall be treated with the same legal validity as an original signed document.
